Recording Disclosure

The short version

When you talk to Mark, our voice agent, the call is recorded and transcribed. We tell you before it starts, every time, and recording never begins before you have been told. You are always talking to an AI and we say so. If you would rather not be recorded, you can use chat or email instead: those are text only, and no audio of you ever exists. You can ask us to delete your recording and transcript at any time.

What this page covers

This page covers conversations with Clawmark’s own agents on clawmarkai.com and on calls we place to you at your request. It does not cover the AI Workforces we build and run for our clients under their own brands; see “Calls with businesses that run on Clawmark” below.

Which conversations are recorded

Voice calls on our website.When you start a voice call with Mark from our site, the call is recorded (audio) and transcribed (text). The recording is the mixed audio of the call: your voice and Mark’s.

Calls we place to you (Call Me Now). If you ask us, during a chat or voice conversation, to call your phone, we place that call and it is recorded and transcribed. Recording on these calls does not begin until after Mark has told you, out loud, at the start of the call.

Live transfer segments. Sometimes our founder, Michael, joins a call live. The recording continues, and Mark reminds everyone on the call, out loud, that the call is recorded at the moment Michael joins.

What is not audio-recorded. Chat conversations with Marty, our chat agent, and email are text. We keep the text (see the Privacy Policy), but there is no audio recording because no audio exists.

Every voice call also produces a written transcript. The transcript is generated as you speak and is stored with the session even when something interrupts the audio upload.

When you consent

Website voice calls: the notice, then your choice to start. Before you can start a voice call on our site, we show you a plain notice next to the start control. It currently reads: “Calls are recorded for quality and training. By starting, you consent to being recorded,” with a link to this page. Choosing to start the call after seeing that notice is your consent. We stamp a timestamped consent record with your session at that moment, including how the consent was given.

Callback calls: your request, then Mark’s spoken disclosure. A Call Me Now call happens only because you asked for it in a conversation with our agents. Before we dial, we save a timestamped record of your own words asking for the call. One request authorizes one immediate callback to the number you gave us in that conversation, nothing more: it is not standing permission to call you later. When you answer, Mark tells you plainly that he is an AI assistant and that the call may be recorded, and recording does not begin until after that spoken disclosure. That disclosure line is a locked requirement in our system: Mark is not permitted to drop or soften it.

Live transfer. When Michael joins, Mark restates on the call that it is recorded. Everyone on the line hears it, including Michael.

We treat every call as an all-party consent call

Some states require the consent of everyone on a call before it can be recorded; others require only one party’s consent. We do not guess where you are calling from and we do not run different rules for different states. Every call gets the strictest treatment: clear notice before recording starts, on every call, for every participant.

If you would rather not be recorded

You always have a text-only path:

  • Chat with Marty on the site. Text only. No audio of you ever exists. We keep the chat transcript as described in the Privacy Policy.
  • Email us at michael@clawmarkai.com. Same: text only.
  • On a call: if you change your mind mid-call, say so or simply hang up, then continue by chat or email. You can also ask us to delete what was captured; see below.
  • A voice call without audio recording: if you want to talk by voice but not be recorded, email us first and we will arrange it. A written transcript of the conversation will still exist.

What happens to recordings and transcripts

Where they live. Recordings and transcripts are stored in private storage with our cloud infrastructure provider, encrypted in transit and at rest. Recording storage is private: there are no public links to any recording.

Who can access them. Each call has a private, unlisted session page showing the transcript and, where a recording exists, a player. That page is reachable only by an unguessable link, it is excluded from search engines, and the audio plays only through short-lived signed links that our system mints on request, and only when your recorded consent is on file. Our system refuses to store or play back a recording without a consent record attached to the session. The session link is sent to Michael so he can prepare for your consultation. Within Clawmark, that is who reviews calls: Michael. The service-provider categories listed below process the content as part of running the service.

How long we keep them. Our retention policy: transcripts are kept for 24 months from the session, then deleted. Audio recordings are kept for 90 days, then deleted, unless the call relates to active work with a client or an active dispute. Contact details you shared are kept while your inquiry or client relationship is active, or until you ask us to delete them.

What we use them for.

  • Answering you in real time during the conversation.
  • Following up with you afterward, if you asked us to.
  • Creating a contact record and interaction summary in our CRM when you show interest in working with us.
  • Reviewing and improving how our agents perform.
  • Keeping records of consent and compliance, and resolving any dispute about what was said.

What we never do. We do not sell recordings or transcripts. We do not share them with advertisers. We do not build voiceprints or use your voice to identify you biometrically.

Who else processes this content

We use a small set of service providers to run the service. We disclose them by category:

  • Cloud infrastructure (hosting, database, and file storage): stores session records, transcripts, consent records, and recordings.
  • AI model providers (speech and language models): process your audio and the conversation text in real time to power the agents.
  • Telephony carriers: carry the audio of Call Me Now phone calls between your phone and our system.
  • Analytics: our site analytics are cookieless and aggregate. Conversation content, recordings, and transcripts are never sent to analytics.

Each provider is permitted to process this content only to provide its service to us.

You are talking to an AI

Mark and Marty are AI agents, and they say so. Mark identifies himself as an AI assistant at the start of phone calls, and our site presents him as an AI throughout. If you ever ask any of our agents whether they are AI, they will tell you plainly. When a human joins a call, Mark introduces him by name so you always know who you are talking to.

Withdraw consent, or ask us to delete your recording

Email michael@clawmarkai.com with the approximate date of your conversation and the phone number or email you used, and tell us what you want:

  • Delete the recording, the transcript, or both.
  • Withdraw consent going forward: we will not record you on future calls, which in practice means we will move you to the text-only channels above or the arranged no-record path.
  • Get a copy of your transcript or recording.

We will act on your request and confirm when it is done. We will respond within 30 days and we will not treat you differently for asking.

One honest caveat: when you ask us to delete a conversation, we keep a minimal record that the conversation happened and that consent was given and later withdrawn (who, when, and the notice shown), because we may need to prove the recording was lawful and that we honored your request. Withdrawal records are kept indefinitely so a revocation is never forgotten and re-contacted.

Text messages

If you agree during a conversation to receive text messages from us, those messages and your opt-in are governed by the SMS sections of our Privacy Policy and Terms of Service, including STOP to cancel and HELP for help. Text messages are not recordings and are not covered by this page beyond this pointer.

Calls with businesses that run on Clawmark

Clawmark builds, deploys, and manages AI Workforces for client businesses. If you call a business whose phones are answered by an AI Workforce we manage, that business’s own recording notice and privacy policy govern your call, and the agent on that call carries the same locked opening disclosure: it identifies itself, says it is an AI, and says the call may be recorded, on every call, in every client deployment. Clients own their customer data, full stop. No data is shared between clients, and conversations from a client’s calls are never used for another client or for our marketing.

Changes to this page

If we change what we record, when we tell you, or how long we keep it, we will update this page and revise the date at the top before the change takes effect. We will not apply a change retroactively to recordings made under an earlier version.
